To start the discussion of this issue BWAP shares with you some of our thoughts on contractual employment.

Under the Labor Code, contractual employment is an exception. Project or fixed term employment is allowable but the project must be clearly identified and the commencement and termination must be clearly stated in the employment contract. The Labor Code favors regular employment. In regular employment, the worker enjoys security of tenure and other benefits and rights provided by law. He may only be dismissed for just cause as provided by law and jurisprudence. In contractual, project or fixed employment, the worker enjoys security of tenure only during the duration of the employment contract. He may be dismissed for violation of the terms of the contract.

In the BPO industry project employment or employment for a fixed period of is the norm.

    In my point of view, In every firms, Project Employment exist especially if there’s a need of additional people depending on the account that the company services with. In IT Industry, IT Professionals are relying on the Project given by the client, On the BPO side, it depends if it is on a season such as in the Customer Service under the Services account such as Flower shops, They add additional agents to be a manpower especially on special occasion on a certain period of time.

    I would agree to the provision that Contracts/Project Employment exists since there’s a high rate of unemployment and underemployment of workers in the country but In my opinion, This should be clear and concise on the no. of years/months that they need to work on a certain project and the worker has a choice to accept it or not.

    I have encountered contracts of employment in BPO companies that is termed “Project Employment Contact” or “Fixed-Term Employment Contract” — specifying therein the name of the foreign client or the project name itself. The problem arises when the term or period of the contract is not specified. Most of these contracts do not specify the period of employment. If this is so, the contract does not fit the Labor Code definition anymore. In effect, these employees should become regular employees because of the defect of the Project/Fixed-Term employment contract.
